If your New Jersey work injury is your fault, you may think that you cannot file a claim. That is not correct. New Jersey has a “no fault” workers’ compensation system. This means that it does not matter if the work injury or exposure is your fault. If you are seeking workers’ compensation benefits, ask yourself the following questions:
- Did the injury arise out of my employment?
- Did the injury happen during the course of my employment?
If you can answer yes to these questions, your injury was work-related and you have a valid claim. The only real exception to this rule relates to intentional injuries. If it can be shown that you intentionally harmed yourself, you will not be entitled to benefits.
